If a man does not appear for a hearing, he can be declared the father by default.

DNA Testing:

This is one certain way to prove paternity. This is a genetic way of proving if people are related with a 99.9 % probability rate. This testing traces no diseases and is not intended for any medical procedure. This process is used in a number of paternity cases, in proving a person is related. DNA testing is generally initiated by a swabbing of the mouth. People can offer chewing gum samples, or saliva. Another name for the swabbing of the cheek is the “Buccal Swab.” After collection, samples are mailed for testing.

At least three types of test are available, each done with relative accuracy, Y-Chromosome, Autosomal (atDNA) and  mitochondrial DNA (mtDNA). Labs will store DNA but upon request by donor will destroy a sample.  DNA is a very powerful tool in the investigation of child paternity and a number of other identification searches.

Many women obtain this service through child support agencies; however, there may be a fee and results should be documented. This testing has the ability to change a person’s life. Realizing a person is a part of your life is, life changing.

When signing a paternity agreement people can change their minds but only under strict circumstances. There are also forms to be signed, called, Rescission of Voluntary Acknowledgement of paternity forms. A signer has a period of 60 days to sign this form, from original signature date. If after this date, the VAP document can only be challenged in court if a person is forced to sign, fraud has been committed or a mistake was made.

Voluntary acknowledgement of paternity makes things very simple. This is as close as it gets without two people being married and acknowledging a child’s birth. The father simply signs the birth certificate with no argument and no court appearances. Declaring the name on the birth certificate is a clean clear way of acknowledging a child and avoiding future confusion.
